Consumers are entitled to a right of withdrawal for contracts for the supply of goods, subject to the provisions set out below.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly fall outside their trade, business, or profession.
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.
To exercise your right of withdrawal, you must inform us, Koch Maschinenbau GmbH & Co. You may use the withdrawal form for this purpose, although it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment you used for the original transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earlier.
You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period has expired. You will bear the direct cost of returning the goods. For goods that, due to their nature, cannot normally be returned by mail (freight goods), the direct cost of return is estimated at approximately EUR 100 at most.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion or Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts
– for the supply of goods that are not prefabricated and for which the consumer’s individual choice or specification is decisive, or that are clearly personalized to the consumer’s requirements;
The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not nationals of a European Union member state and whose sole place of residence and delivery address at the time of conclusion of the contract are located outside the European Union.
